IT Live Terms of Service

1. Who we are

IT Live is a trade name of Aanbod op Maat, registered at Herikerbergweg 292, 1101 CT Amsterdam, Netherlands. D-U-N-S number 473783386. Contact: info@itlive.nl, +31 85 8002 035.

2. Applicability

These terms apply to any use of our services, including the itlive.nl platform, mobile applications (iOS + Android), hosting, Sophie AI assistant, website building, domain registration and related services. Deviations only apply if agreed in writing.

3. Accounts and access

• You get an account via an 8-letter code or via email + password. You are responsible for keeping these credentials secret.
• Account misuse (such as sharing outside your organization) can lead to suspension.
• Report unauthorized use immediately via info@itlive.nl.

4. Service use

You may only use the service for legitimate business purposes. Not permitted:

• Publishing content that violates laws and regulations (including copyright, defamation, hate speech, privacy violations).
• Stressing the infrastructure with spam, crawlers or denial-of-service patterns.
• Reverse engineering our software or security.
• Misusing AI functionality to phish, build malware or deliberately produce misleading content.

5. Sophie AI assistant

Sophie works with various language models. We do our best to make responses accurate, up-to-date and safe, however:

• AI output may contain errors. You evaluate and bear final responsibility for use (e.g. posting on your website, sending to customers).
• We apply automatic placeholder replacement to mask sensitive data before it goes to AI providers (see privacy policy §4).
• Your content is not used to train public models.

6. Your content and ownership

• All content you upload or create (text, photos, CRM data, files) remains your property.
• You grant IT Live a limited license to store, process and display the content for service delivery.
• We do not use your content for marketing or resale.

7. Payment and prices

• Subscriptions are billed monthly or yearly, as agreed.
• One-time services (domain registration, setup) are invoiced immediately upon purchase.
• Upon late payment we first send a reminder; after 14 days we may suspend the service until payment is received.
• All prices are in euros, excluding VAT unless otherwise stated.

8. Cancellation

• Monthly subscriptions: cancellable per month, at least 1 day before the next invoice date.
• Yearly subscriptions: cancellable up to 30 days before the renewal date.
• Cancel via info@itlive.nl or via your account settings.
• Upon cancellation your data remains available for export for 30 days, then is permanently deleted (except legally required administration, retention 7 years).

9. Availability and maintenance

We aim for 99.5% uptime per month. Planned maintenance is announced at least 48 hours in advance. Unplanned maintenance (e.g. during a security incident) may occur immediately.

10. Liability

• Our total liability is limited to the amount you paid in the 3 months preceding the incident.
• We are not liable for indirect damages, lost profits or data loss due to your breach of these terms.
• This limitation does not apply in cases of intent or gross negligence by IT Live.

11. Security and data

We take appropriate technical and organizational measures (TLS 1.3, AES-256, EU hosting, logging, pentest). See our privacy policy for details.

12. Changes

We may amend these terms. For material changes we notify you by email and show a banner in the dashboard. Continued use after the effective date implies agreement.

13. Governing law

Dutch law applies to these terms. Disputes are submitted to the competent court in the Limburg district, unless mandatory law dictates otherwise.
